Richard E. Donaldson, Esq. has been representing the handicapped and elderly before government agencies for more than three decades. He has presented thousands of people from their first denial through all administrative stages to the Federal Court at every appellate level.
Richard has been a lecturer on Social Security and Medicare in Las Vegas, Washington DC, New York and Chicago. He founded the Las Vegas Senior Citizens Law Project and lobbied the legislation that funded it. Richard has lived in Nevada since 1960. He graduated from UNLV and California Western School of Law with a Juris Doctrate degree in law.
Richard represented the Nevada handicapped in a class action law suit against the government when Social Security stopped benefits and medical insurance in an action intended to cut costs. These people had already proved that they could not work. Most of them relied entirely on Social Security benefits. Medicare or Medicaid was their only source of medical care. Those selected were forced to prove, once again, that they were disabled. The Social Security Administration, like all indivuals and other entities are obliged to follow and apply the law as it is interpreted by the courts. The agency refused to follow court decisions and the class action (Lopez v Heckler and similar cases in other circuits) eventually reached the US Supreme Court, attracted the attention of congress and the agency relented.
